Terms of Service

1. Agreement

By using LoonBox, the loonbox.app website, The Nest marketplace, or Tremolo music platform (collectively, the "Service"), you agree to these terms. The Service is operated by MPLS LLC ("we", "us", "our").

If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use LoonBox. Features involving purchases (Tremolo, The Nest) require you to be at least 18, or have parental/guardian consent.

3. Your Account

• You are responsible for maintaining the security of your account credentials
• One account per person
• You must provide a valid email address
• We may reclaim inactive usernames after 12 months of inactivity with 30 days notice
• You may not impersonate another person or entity

4. The Application

LoonBox is a desktop music player for your local music library. You are responsible for ensuring you have the legal right to play any music files in your library. We do not host, stream, or distribute music through the core application.

5. Your Content

Local Data

Your music library, playlists, and settings remain on your device and under your control. We make no claim to any content stored locally.

The Nest Submissions

If you publish feathers (themes) or extensions to The Nest:

• You retain full copyright ownership of your work
• You grant MPLS LLC a non-exclusive, royalty-free license to host, distribute, and display your submission through The Nest
• You represent that your submission does not infringe on any third-party rights
• You agree to the Content Policy for all published content

Tremolo

If you distribute music through Tremolo:

• You must own or have authorization to distribute the content
• You retain full copyright ownership
• You grant MPLS LLC a non-exclusive license to facilitate distribution and display metadata (title, artist, artwork) on the platform
• Revenue splits and payout terms are governed by the separate Tremolo Artist Agreement

6. Social Features

LoonBox accounts may include social features such as following other users, sharing playlists, and a listening activity feed. When using social features:

• Respect other users — harassment, hate speech, and spam are prohibited
• You control what is visible on your profile through privacy settings
• Shared playlists grant view access only — recipients cannot modify your playlists
• You may block any user at any time

7. Extensions and Permissions

LoonBox extensions run in a sandboxed Lua environment with a permission model:

• Extensions must declare all required permissions in their manifest
• You must approve permissions before an extension is activated
• Extensions cannot access your filesystem outside of designated directories
• Network access is limited to domains declared in the extension manifest

We review extensions published to The Nest but cannot guarantee they are free of bugs or unintended behavior. Install extensions at your own discretion.

8. Prohibited Conduct

You agree not to:

• Distribute malware or malicious extensions through The Nest
• Use Tremolo to distribute content you do not have rights to
• Attempt to circumvent the extension sandbox or permission system
• Reverse engineer, decompile, or tamper with license verification systems
• Harass, abuse, or threaten other users through social features
• Use the Service for any illegal purpose
• Scrape, crawl, or automated-access The Nest or Tremolo catalogs

9. Intellectual Property

Open Source

LoonBox source code is available under the GNU Affero General Public License v3.0 (AGPL-3.0). See our Licenses page for details.

Ecosystem Carve-Out

Feathers and extensions that interact with LoonBox solely through the documented public APIs may be distributed under any license. The AGPL-3.0 does not extend to these works.

Trademarks

The LoonBox name, logo, and loon mascot are trademarks of MPLS LLC. You may not use these marks in a way that implies endorsement without written permission.

10. Purchases and Payments

Purchases through Tremolo and The Nest are processed by third-party payment providers. All sales are final unless the content is defective or materially misrepresented. Refund requests may be submitted to support@loonbox.app.

11. Account Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these terms, with notice except in cases of severe violations (malware distribution, illegal content).

Upon termination:

• Your account data is deleted per our Privacy Policy
• Purchased Tremolo content remains accessible for re-download for 90 days
• Published Nest content may be removed at our discretion

12. Enforcement and Appeals

Violations are handled on a tiered basis:

All enforcement actions are appealable by emailing appeals@loonbox.app. Appeals are reviewed by a different team member than the original decision.

13. Disclaimers

The Service is provided "as is" without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that any content on Tremolo or The Nest is free of defects.

LoonBox is a tool for playing your local music library. We are not responsible for the legality of files in your library.

14. Limitation of Liability

To the maximum extent permitted by law, MPLS LLC's total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $50, whichever is greater.

15. Governing Law

These terms are governed by the laws of the State of Minnesota, USA, without regard to conflict of law principles.

16. Changes to These Terms

We will provide at least 30 days notice before material changes take effect, via email or in-app notification. Continued use after the effective date constitutes acceptance.
